Significant benefits: Singapore announced an exemption from consumption tax on the supply of payment digital currencies

On July 5, the Inland Revenue Authority of Singapore (IRAS) announced the latest draft: the supply of payment digital currency is exempt from consumption tax (GST), which will take effect from January 1, 2020. According to the current policy, the supply of payment digital currency is considered a taxable service supply. Therefore, for companies registered with GST, any sale, issuance, or transfer of digital payment currency is applicable to GST. When these payment digital currencies are used to purchase goods and services, a double taxable supply occurs: the taxable supply of this payment digital currency and the taxable supply of goods (services). In order to avoid the above double tax supply situation, the Singapore Inland Revenue Department announced: a. Using payment digital tokens to purchase goods or services is not a taxable “supply” and does not need to be included in the scope of GST taxation. b. Using payment digital currencies to exchange (trade) fiat or other types of payment digital currencies (including ICOs) is exempt from GST. Note: The “supply” mentioned in the article refers to “service/product supply” from a consumption tax perspective. It is not limited to “distribution”, but also includes “sale” and “exchange.” The “Draft” only adjusts the tax policy for payment digital currencies (DPT) and does not apply to other types of “digital currencies”. So what is the specific definition of DPT? The definition of a digital payment currency (DPT) is in the “Draft” just published by the Singapore Inland Revenue Department, which clearly defines DPT. Generally speaking, DPT must meet the following conditions: (a) expressed in units; (b) interchangeable; (c) not denominated in any currency or linked to the value of any other currency (such as stablecoins) (d) it is (or will become) a publicly accepted medium of exchange, and there are no substantial restrictions on its payment function. Examples of DPT include Bitcoin, Ethereum, Litecoin, Dash, Monero, Ripple, and Zcash. Key Case Study Case 1: Using DPT as a Payment Medium GST Registered Company A uses Bitcoin to purchase software from GST Registered Company B. As of January 1, 2020, Company A's purchases will not be considered a Bitcoin supply, so there is no need to calculate output tax. But Company B still has to pay taxes on the software it supplies. Case 2: Trade DPTGST registered company C to exchange Bitcoin with GST registered company D for ether. As of January 1, 2020, both companies' supply practices are exempt from GST. They don't have to charge/factor in output taxes. However, when preparing the GST statement, suppliers C and D, as exempted, still need to report the net gain/loss resulting from the transaction. Case 3: DPT Token Offering (ICO) GST Registered Company E issues DPT - X to the Singaporean public through an ICO in exchange for Singapore dollars. As of January 1, 2020, E's proceeds from token issuance will be treated as exempt from GST supply.
